Terms and Conditions for EMI Recovery App

Welcome to the Phoneshield ("App"), operated by Jainam Venture ("We", "Us", or "Our"). These Terms and Conditions ("Terms") govern your use of the App and its services. By downloading, installing, or using the App, you ("User", "You", or "Your") agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Purpose of the App
The EMI Recovery App facilitates the recovery of Equated Monthly Installments (EMIs) by verifying user information and providing security features. These include background location tracking, SIM tracking, social media app locking, device settings locking, device locking, device MPIN changes, notifications, and additional features to ensure secure and efficient EMI recovery, fraud prevention, and compliance with financial obligations.
2. Eligibility
To use the App, you must:
- Be at least 18 years of age or have the legal capacity to enter into a binding agreement.
- Have an active EMI agreement with a financial institution or lender associated with our services.
- Provide accurate and complete information during registration and throughout your use of the App.
3. User Responsibilities
As a user, you agree to:
- Provide Accurate Information: Ensure all information, including contact details, financial information, location data, and device information, is accurate and up-to-date.
- Grant Permissions: Allow necessary permissions, including background location, device administration, accessibility services, phone state, and notification access, to enable the App’s core functionality. Denying permissions may limit or prevent App services.
- Comply with Laws: Use the App in compliance with all applicable local, national, and international laws, including data privacy and financial regulations.
- Secure Your Account: Protect your account credentials and notify us immediately of unauthorized access or security breaches.
- EMI Obligations: Fulfill your EMI payment obligations as agreed with your lender. The App does not modify or waive these responsibilities.
- Cooperate with Security Features: Acknowledge and cooperate with features like social media app locks, device locks, settings locks, and MPIN changes, which are implemented to secure the recovery process.
4. App Features and Permissions
The App provides the following features to support EMI recovery, and you agree to grant the necessary permissions for their operation:
- Background Location Data: Collects location data when the App is not in use to verify your address, prevent fraud, and streamline recovery. Requires "Allow all the time" permission, revocable via device settings, though this may limit functionality.
- SIM Tracking: Monitors SIM card changes to detect unauthorized device use or fraud. Requires phone state permission.
- Social Media App Lock: Locks social media apps to prevent misuse during recovery. Requires accessibility services permission.
- Settings Lock: Restricts device settings to prevent changes that could interfere with recovery. Requires device administration permission.
- Device Lock: Locks the device in cases of non-compliance or suspected fraud. Requires device administration permission.
- Device MPIN Change: Changes the device’s MPIN to secure the device during recovery. Requires device administration permission, with instructions provided to regain access.
- Notifications: Sends payment reminders, recovery updates, or security alerts. Requires notification access permission.
- Other Features: Includes call monitoring, app usage tracking, remote data wiping, or other security measures to ensure compliance. Requires additional permissions as prompted.

5. Prohibited Activities
You agree not to:
- Use the App for illegal or unauthorized purposes.
- Bypass, disable, or manipulate security features, including location tracking, SIM tracking, app locks, or device locks.
- Provide false or misleading information to evade EMI recovery.
- Reverse-engineer, decompile, or access the App’s source code.
- Interfere with the App’s operation, including introducing viruses or malicious code.
- Disable or circumvent required permissions, such as device administration or accessibility services.
- Uninstall the App without authorization during active EMI recovery.
6. Intellectual Property
All content, features, and functionality of the App, including text, graphics, logos, and software, are the property of Jainam Venture or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
7. Third-Party Services
The App may integrate with third-party services, such as financial institutions or analytics providers. We are not responsible for their practices or terms. Review their policies before engaging with their services.
8. Limitation of Liability
To the maximum extent permitted by law, Jainam Venture shall not be liable for damages arising from:
- Use or inability to use the App, including features like SIM tracking or device locks.
- Errors, inaccuracies, or delays in services, including location verification or notifications.
- Unauthorized access to or loss of data, despite our security measures.
- Actions by third parties, such as lenders or recovery agents, based on App-provided information.
- Inconvenience from device locks, MPIN changes, or restricted access to social media or settings.
The App is provided "as-is" without warranties of any kind.
9. Indemnification
You agree to indemnify Jainam Venture, its affiliates, and employees from claims or damages arising from your violation of these Terms, misuse of the App, or failure to fulfill EMI obligations.
10. Termination
We may suspend or terminate your access to the App if you:
- Violate these Terms.
- Engage in fraudulent or illegal activities.
- Fail to provide accurate information or required permissions.
- Attempt to disable or uninstall the App without authorization.
Upon termination, your right to use the App ceases, but EMI obligations remain. Device locks or MPIN changes may persist until recovery obligations are resolved.
11. Governing Law
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts in [Your City], India.
12. Compliance with Laws
We comply with applicable laws, including the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023 (if enforced). You agree to use the App in compliance with all relevant laws.
13. Changes to These Terms
We may update these Terms to reflect changes in services or legal requirements. We will notify you of material changes via the App or email. Continued use of the App constitutes acceptance of updated Terms.
